Aeronautical obstacles - apply for authorisation

Do you want to erect a building in the vicinity of an aerodrome or air traffic control facility,erect a mast , build a dam, erectother structures or facilities or operate equipment such as a construction crane, mobile crane, concrete pump or drilling rig ?

Then you will need a licence under aviation law. This depends on

• the distance to the aerodrome reference point or to the runway of an aerodrome,
• the distance to air traffic control facilities
• the type and height of the structure or the equipment to be operated.

A construction protection zone is always defined for commercial airports. This surrounds the airport with a radius of six kilometres. In the approach sectors, however, it extends up to a distance of 15 kilometres.

A special construction protection zone may also be established for other airports. At the very least, however, the construction protection zone encloses an airfield with a radius of 1.5 kilometres. If you are unsure whether the site is located in a construction or facility protection area, you can send an informal preliminary enquiry by e-mail to find out whether a permit will be required.

The protection zone for aeronautical navigation facilities depends on the type of facility Installation. Such navigation systems are not only found in the vicinity of airports. The Federalthe Federal Supervisory Authority for Air Navigation Services examines whether the statutory construction ban applies if buildings or other facilities or equipment can cause interference with navigation systemsinterfere with navigation systems.

You need a licence under aviation law if installations represent an obstacle to air traffic or could lead to interference with air traffic control systems. This may be the case, for example, with buildings, aerials, chimneys, construction cranes, mobile cranes and other construction equipment, even trees or groups of trees.

Note: If you require a building permit for the construction of a building, you do not need to apply separately for the aviation permit for the buildingseparately. The building authority involves the aviation authority as part of the building permit procedure
